The U.S. Supreme Court’s decision in Obergefell v. Hodges last Friday has at least one significant impact on property rights. States provide numerous protections for married couples, among them is the ability to hold title to real property as tenants by the entirety. The Supreme Court’s opinion will now give same-sex couples the ability to take title to real property as tenants by the entirety, the strongest way to hold title.
